On 10 April, Decree of the Head of the Donetsk People’s Republic No.83 approved the Procedure for processing and issuing certificates of unlawful detention on the territory of the state of Ukraine, and a number of amendments have been made to the Provision on the passport of a citizen of the Donetsk People’s Republic.

The specified normative legal act regulates the procedure and terms for issuing a certificate confirming the fact of unlawful detention of a person on the territory of the state of Ukraine and transfer to the territory of the Donetsk People’s Republic as a result of an exchange. The certificate gives the right to persons of this category to receive a passport of a citizen of the Donetsk People’s Republic.

In accordance with the approved Procedure, the processing and issuance of certificates of unlawful detention on the territory of the state of Ukraine are carried out by the Office for Social Affairs of Retired Servicemen and Patriotic Education to the Head of the Donetsk People’s Republic on the basis of the lists submitted by the Human Rights Ombudsman.

The procedure for processing a certificate provides for a personal appeal of an individual with the necessary set of documents to the specified Office. When applying to the Office, the following are provided: an application for the issuance of a certificate of a standard form; two photographs in colour, size 30×40 mm; identification documents (if any); certificate of release from places of deprivation of liberty on the territory of the state of Ukraine (if any); consent to the processing of personal data.

The issuance of a certificate is carried out within 10 days from the date of the citizen’s appeal, and in cases requiring additional verification activities, within a period not exceeding one month.

It should be noted that certificates of unlawful detention on the territory of the state of Ukraine, previously issued by the Ministry of Defense of the Donetsk People’s Republic, are valid and cannot be replaced.
