On 26 June the representatives of Human rights Ombudsman in DPR attended a regular plenary meeting of the DPR People’s Council of the second convocation.
Taking into account inviolability of the basis of the public social policy of the Donetsk People’s Republic with respect to the protection and promotion on the implementation of legal rights certain categories of civilians, who are needed in the providing of state support in the form of social guarantees in different spheres of vital activity, parliamentarians unanimously adopted the draft legislation “On Amendments to the Article 18 of Law of the Donetsk People’s Republic № 09-IHC from 13.02.2015 “On the status of military personnel”.
Thus, Clause 7 Article 18 of the abovementioned Law is changing, owing to which, children of servicemen, doing military service, who sustained injuries, deceased or died because of injuries (wounds, traumas, concussions) or deceases, received in connection with the performance of military duties, have right of priority admission to educational institutions, and also resting in summer recreation establishments.
At the same time, legal provisions of the draft law, providing the social guarantees children of mentioned categories of servicemen on the access of education and possibility of recuperation on favourable terms, state that realization of approved social support of children will implement in public and municipal educational establishments of general education (preschool, primary, secondary and basis general education) and in summer recreation camps.
Approval at the legislative level of guarantees of priority admission children of servicemen to educational organizations and summer recreation establishments will promote the strengthening of comprehensive and prosperous developing of children, family members of whom stand guard of public interests of the Donetsk People’s Republic.
Also, in the course of the process of legislative work of parliamentarians in two readings the draft law “On Amendments to the Articles 19 and 37 of Law of the Donetsk People’s Republic № 25-IHC from 20.03.2015 “The Legal Profession and Legal Practice”.
The essence of adopted amendments is in the concretization of the sequencing of implementation police operations events and investigations regarding lawyers of the Donetsk People’s Republic. Certain provisions of the Law of DPR “The Legal Profession and Legal Practice” in this connection will be set in a new edition in accordance to which impermissibility on the demand from lawyers, workers of lawyer establishments, connected to the provision of legal services in the framework of particular cases is established. And furthermore, the draft law includes changes on the prohibition of prosecution of a lawyer for his expression of personal human rights position (opinions, beliefs, etc.). A guarantee of freedom of the announcement of legal beliefs will act independently of suspension or cessation of the status of the lawyer. Meanwhile, the draft law provides that the order of prosecution of lawyers will be implemented in accordance with the Criminal Procedure legislation of the Donetsk People’s Republic with the preservation of guarantees of their protection from possible threats of unlawful impact on comprehensiveness and objective of provision of legal aid by lawyers.
The next one from form essential changes is the adopting of the draft law “On Amendments to the Article 2 of Law of the Donetsk People’s Republic “On perpetuating Victory of the Soviet people in the Great Patriotic War 1941-1945”.
Thus, taking into account the immeasurable contribution to the fight against German Nazi, bearing in mind the common historical significance in the defeat of fascist invaders, according to the perpetuating of heroic exploits of the Soviet people, based on the scale of the tragedy of consequences of the inhuman policy of Germany, which has declared the war on the whole world, on 22 June in Donetsk People’s Republic on the Day of Memory and Mourning, day of the beginning the Great Patriotic War, annual holding the common republican moment of silence at 12:15 (Moscow time) is established because it is the same time of official appeal towards soviet citizens on the sudden attack on the Soviet Union by Germany.
Meanwhile, in the course of the planner meeting of the DPR People’s Council the draft law “On the prohibition of the sale of tobacco products, electronic nicotine delivery systems to persons younger than 18 years of age” was adopted, which provides for not only requirements according to the impermissibility of sale of tobacco products to persons younger than 18 years of age, but also provides for administrative proceedings of perpetrators, violated statutory orders of this Law.
Furthermore, in the Donetsk People’s Republic in the frameworks of the adopted draft law “On Amendments to the Article 13 of Law of the Donetsk People’s Republic “On Road Traffic”, there are reviewed the main provisions on accession/prohibition of driving vehicles due to availability of certain medical restrictions and contraindications.
The above-mentioned draft laws will come into force after the publishing on the official website of the People’s Council of the Donetsk People’s Republic.
