ON COMPENSATION FOR LOST, DAMAGED RESIDENTIAL BUILDINGS AND PROPERTY OF FIRST NECESSITY

As part of legal education, we inform citizens that in order to ensure social protection of persons affected by hostilities on the territory of the Donetsk People’s Republic, the Decree of the State Defence Committee of the DPR No. 175 of 30.07.2022 continues to operate.

According to the Procedure approved by the Decree of the State Defence Committee of the DPR No. 175 of 30.07.2022, residential buildings damaged as a result of hostilities, starting from February 24, 2022, can be recognized as lost and damaged.

Citizens have the right to apply for compensation for lost or damaged residential buildings, as well as for lost property of first necessity, to the Commission to review applications of persons affected as a result of hostilities. Such Commissions were created under the administrations of districts, cities and districts in the cities of the Donetsk People’s Republic.

The amount of compensation is:

  • for lost housing – 35,000.00 Russian rubbles per 1 m2;
  • for damaged housing – 6,000.00 Russian rubbles per 1 m2, based on the total area of ​​the damaged housing or its part (room);
  • for partially lost property of first necessity – 50,000.00 Russian rubbles per person;
  • for total lost property of first necessity – 10 0,000.00 Russian rubbles per person.

In case of loss or damage of residential premises after the repair, compensation can be provided again.

In addition, compensation for lost housing may be provided in the form of housing in multi-family housing stock. The limiting size of compensatory housing cannot exceed 150 m2.

It should be noted that when applying on behalf of the owner (tenant) of the lost or damaged residential premises, his/her legal representative must additionally submit documents certifying the powers of the legal representative, as well as documents proving his/her identity.

The above documents are submitted by the applicant, the legal representative of incapacitated, partially capable family members, children under guardianship or trusteeship, as well as a person acting under a power of attorney issued by the authorized body of the Russian Federation.
