On December 8, 2022, a draft law on the establishment of courts of the Russian Federation on the territory of the Donetsk People’s Republic was submitted to the State Duma of the Russian Federation.

The draft law provides for the creation on the territory of the Donetsk People’s Republic of federal courts of general jurisdiction, an arbitration court and a military court.

Planned strength:

  • judges – 785 people;
  • employees of court apparatuses – 2155 people;
  • personnel for the protection and maintenance of ships – 612 people.

According to the text of the draft law, the decision on the day of the beginning of the activities of the courts is made by the Plenum of the Supreme Court of the Russian Federation after the appointment of at least 1/2 of the established number of judges of the corresponding court.

The draft law also contains provisions that the courts that were in force on the day of the accession of the Donetsk People’s Republic to the Russian Federation and a new subject was formed as part of the Russian Federation continue to administer justice on behalf of the Russian Federation in the specified territory up to a certain day of commencement of the activities of the courts established in accordance with the provisions of the said draft law under the decision of the Plenum of the Supreme Court of the Russian Federation.

In addition, the draft law states that cases, complaints accepted for consideration by courts of general jurisdiction operating on the territory of the Donetsk People’s Republic on the day t of the accession of the Donetsk People’s Republic to the Russian Federation and a new subject was formed as part of the Russian Federation, and not considered on that day, are transferred for consideration to the federal courts of general jurisdiction, created in accordance with the provisions of the introduced draft law, taking into account their territorial jurisdiction.

The adoption of the draft law will ensure the administration of justice on the territory of the DPR, as well as the implementation of the constitutional right of the population living in the Republic to have access to justice.
