With the onset of the spring-summer period, street sale of various food and non-food products is increasing.
A citizen who sells any goods, doing an entrepreneurial activity, is not always registered in the manner prescribed by law in the republican tax authorities, as an individual entrepreneur (natural person-entrepreneur), a legal person.
These persons sell various goods (seeds, seedlings, herbs, milk, etc.) from trays, boxes and other improvised constructions, without having the appropriate permission to trade, in undisclosed places.
Administrative liability for selling in undisclosed places is regulated by the Code of Ukraine on Administrative Offenses (as amended in the territory of the DPR).
So, according to Clause 1 of Article 160 of the Code of Ukraine on Administrative Offenses, selling in cities on the streets, squares, courtyards, entrances, squares and other undisclosed places leads to the imposition of a fine from one to seven tax-free minimum incomes of citizens with or without confiscation of trade items.
In accordance with Clause 2 of the aforementioned Article, selling in undisclosed places in industrial goods leads to the entails the imposition of a fine from six to fifteen tax-free minimum incomes of citizens with confiscation of trade items.
That is, the sanction of Article 160 of the Code of Ukraine on Administrative Offenses for committing the above offense provides for the imposition of an administrative fine in the amount of 34 rubles to 510 rubles. In this case, the confiscation of the goods sold or the imposition of a punishment without such a measure is allowed.
Thus, persons who carry out selling in undisclosed places should remember about the imposition of administrative responsibility for this offense and imposing an appropriate penalty in the form of a fine and confiscation of goods.
Residents of the Republic, who purchase goods in undisclosed places, should take into account that they may not meet hygienic requirements for nutritional value and safety of food products and food commodities, and sellers of goods do not guarantee respect for the consumer rights.
